The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the entire proceedings of Criminal Case No. 492 of 2025, (State Vs. Nitin Gupta) arising out of Case Crime No. 238 of 2024, under Sections 281, 125(b) of B.N.S. Act (under Section 380, 411 of I.P.C.), Police Station- Sector 126, District- Gautam Buddha Nagar, as well as cognizance/ summoning order dated 09.01.2024 pending in the Court of Additional Civil Judge (Senior Division) Ist,/ Additional Chief Judicial Magistrate, Gautam Buddha Nagar. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
