Item No. D-3 The General Manaer, Maharashtra Telecom Circle Vs. M/s Super Plateck Private Limited.
OMP (M) No. 348 of 2024
03.01.2025 Present: Mr. Piyush Verma, Senior Advocate with Mr. Anuj Bali, Advocate, for the applicant/appellant.
Mr. Vinay Kuthiala, Senior Advocate with Mr. Rahul Mahajan, Advocate, for the respondents. Caveat Petition No. 467 of 2024 Discharged. The petition stands disposed of.
OMP(M) No. 348 of 2024 Notice. Mr. Rahul Mahajan, Advocate, waives service of notice on behalf of the respondents. In the application seeking condonation of delay in filing the appeal against the judgment dated 12.12.2022, it has been mentioned that an SLP was filed before the Apex Court, which has been dismissed on 11.11.2024, on the ground that an appeal would be maintainable before this Court. The delay is stated to be of 3 months and 27 days. Perusal of the order of the Apex Court itself would go on to show that if the appeal was to be filed within four weeks from 11.11.2024, the same would not be dismissed on the ground of delay. The appeal was filed on 05.09.2024. In such circumstances, we are of the considered view that sufficient cause has been made out to condone the delay in filing the appeal. Accordingly, the application is allowed and
the delay in filing the appeal is condoned. The application stands disposed of. LPA No. of 2025 Appeal be registered. Issue notice. Mr. Rahul Mahajan, Advocate, accepts notice on behalf of the respondent. Now to come up for consideration on 02.04.2025.
