For Respondent(s) : Mr. Samee Khan & Ms. Sunita Meena on behalf of Mr. Bhuwnesh Sharma, AAG. HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 24/03/2025 These appeals have been filed by the appellants challenging the order dated 01.04.2022 passed by the learned Single Judge in S.B. Civil Writ Petition No.4151/2012 whereby the learned Single Judge has granted certain benefits claimed in the writ petition. The petitioner as well as the respondents both are aggrieved by the order dated 01.04.2022 passed by the learned Single Judge, therefore, they both have filed these appeals. This court while issuing notice to the respondents stayed only back-wages part of the order dated 01.04.2022 passed by the learned Single Judge in S.B. Civil Writ Petition No.4151/2012. We have heard counsel for both the parties and find that the appellant-petitioner has already been reinstated in the service and he remained absent from duty for a period of about three years. In the circumstances before us, We deem it just and proper to modify the order dated 01.04.2022 passed by the learned Single Judge only to the extent that the appellant-petitioner is entitled for 50% of the back-wages instead of full back-wages. [2025:RJ-JP:13127-DB] (3 of 3) [SAW-810/2022] In that view of the matter, these appeals are accordingly disposed of. (PRAMIL KUMAR MATHUR),J (INDERJEET SINGH),J MG/92-93
