Smt. Keshari Devi vs. Rugved Milind Thakur
CMP(T) No.58 of 2025 in COPC(T) No.198 of 2020
12.08.2025 Present Ms. Babita Chauhan, Advocate, for the petitioner.
Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C.Verma, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General, for the respondent-State.
By way of reply to the application, it has been stated that respondents after having considered the case of the petitioner in light of judgments passed by this Court in CWP-T No.8964 of 2008, titled Prem Raj and another vs. State of Himachal Pradesh and others and CWP No. 4369 of 2012, titled Mani Ram vs. State of Himachal Pradesh and others, have passed detailed and reasoned order dated 21.04.2017, thereby rejecting the case of the petitioner. It is averred in the reply that since case of the petitioner is not identical to the cases of Mani Ram and Prem Raj, as detailed hereinabove, he cannot be granted similar benefits. Since there was only direction to consider and decide the case of the petitioner in light of aforesaid judgments, as detailed hereinabove, and respondents, while complying with the aforesaid direction, have already passed detailed order dated 21.04.2017 (Annexure R-1), this Court finds none of the action of the respondents to be contemptuous and accordingly present petition is disposed of. Notices issued to the respondents are hereby discharged. However, liberty is reserved to the
petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to the order passed in purported compliance of the judgment alleged to have been violated. (Sandeep Sharma) Judge August 12, 2025 (shankar)
