JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 12-05-2025 Heard learned counsel for the petitioner as well as learned APP for the State. 2. In this case, the petitioner is seeking regular bail in connection with Mohania P.S. Case No. 747 of 2024, registered for the offences punishable under Sections 310(4)/ 310(5)/317(5)/111(3)(4)/3(5) of the BNS and 25(1-b)(a)/26/35 of the Arms Act and 8(C) and 21(b)/20(b),11A of NDPS Act. 3. As per allegation, 15.32 gm of heroin like substance was recovered from the possession of the petitioner and a pistol was recovered from the possession of co-accused Sohrab Farooqi. 4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in Patna High Court CR. MISC. No.17455 of 2025(3) dt.12-05-2025 2/2 this case. The quantity of contraband alleged to have been recovered from possession of the petitioner is below the commercial quantity. The petitioner is under custody since 11.11.2024. 5. The petitioner was arrested at the spot. 15.32 gm of heroin was recovered from possession of the petitioner and he has a criminal antecedent of similar nature of case. 6. In my view, the petitioner does not deserve the privilege of bail. Accordingly, it is rejected. kundan/- (Nawneet Kumar Pandey, J) U T
