GINJUPALLI SUBBA RAO The Court made the following: ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..declaring the action of the 2nd respondent in issuing the Proceedings in Rc.D1/3315/2016-1, dated 23.05.2016 appointing the respondents 5 to 9 as Trustees to the 4th respondent temple as illegal, improper, unjust, contrary law and violation of Ses.15 (2) and 17 (5) of A.P. 2 Charitable Hindu Religious Institutions and Endowment Act, 1987 and further direct the respondents not to administer oath as trustees to the 4th respondent temple and pass such other order of orders in interest of the justices.” 2. Heard Mr.Mahadeva Kanthrigala, learned counsel for the petitioner and learned Assistant Government Pleader for Endowments, appearing for the respondents 1 to 3. 3. On hearing, learned counsel for the petitioner reiterated the contentions which are urged in the writ petition. 4. On the other hand, the 2nd respondent filed counter along with leave petition. While denying the contents of the writ petition, stated that, the 2nd respondent has issued notification in Rc.No.B1/16201/2015-13, dated 06.08.2015 inviting applications from the interested persons for the trusteeship of 4th respondent temple and on receipt of applications and on verification of their antecedents, the Assistant Commissioner of Endowments Department, has submitted a report dated 28.01.2016 to the 2nd respondent. After careful examination of the record while exercising the powers conferred under sub- section (2) of Section 15 of the Andhra Pradesh Charitable and Hindu Religious Institutions And Endowments Act, 1987, has issued proceedings dated 23.05.2016 appointing respondents 5 to 9 as trustees of the 4th respondent temple for a period of two years from the date of taking oath of office and secrecy. Accordingly, the respondents 5 to 9 made oath and discharged their term of two years period as trustees to the 4th respondent 3 temple, as such, this writ petition has become infructuous and liable to be dismissed. 5. In view of the contents of the counter, nothing survives in this writ petition for further adjudication. 6. Accordingly, the Writ Petition is closed. No order as to costs. 7.
