2. This bail application has been filed by the petitioner namely, Dr. Selim Atique Rabbani under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking bail in connection with Goalpara PRC Case No. 581/2025 under Section 69 of BNS, 2023 (Corresponding to G.R. Case No.666/2025).
3. The allegations as reflected in the FIR involve the petitioner having sexual intercourse with the informant upon a promise of marriage. There is also a counter FIR having been lodged by the petitioner against the informant of the instant case, alleging among other things an attempt to assault the petitioner with a dao.
4. The learned counsel for the petitioner submits that the present case is nothing but a case of honey trapping and that the petitioner is a government servant and there is no chance of him absconding. He further submits that the petitioner has already spent nearly 50 days behind the bars. Further, since the charge-sheet has already been submitted in both the cases, there is no necessity of his further detention.
5. Having regard to the above, it is provided that the petitioner, named above, shall be released on bail of Rs. 50,000/- (Rupees Fifty Thousand) with one surety of the like amount to the satisfaction of the learned Eleka Magistrate in connection with the aforementioned case.
