This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“....
a Writ of Mandamus i)declaring the action of the 7th respondent Station House Officer in registering crime vide FIR No.26 of 2025, dt.04-04-2025 U/Secs.329(4), 115(2), 118(1), 351 (2), 79, 329(2), 137(2), R/w. 3(5) BNS on the file of 7th respondent police station without showing Section 109 of BNS and also the action of the 7th respondent Station House Officer in registering ii) crime by showing Section 118 (1) of BNS instead of registering the same under Section 118 (2) of BNS as illegal, arbitrary, discriminative, abuse of process of law, colorable exercise of powers, non-application of mind. misfeasance, malfeasance, nonfeasance and also besides violative of Section 173 of BNSS, Articles 14, 19 and 21 of the Constitution of India and consequently, direct the 7th respondent Station House Officer to file iii) appropriate Memo before the competent court for adding of Section 109 of BNS and also direct him to file appropriate Memo for altering of Section from Section 118 (1) of BNS to Section 118 (2) of BNS besides imposing exemplary costs on the 7th respondent Station House Officer and also against the unofficial respondents besides directing the 7th respondent and also all unofficial respondents to pay costs of these proceedings.”
2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions would submit that, after receipt of Wound Certificate, the Section of Law was altered from 118(1) to 118(2) of BNS and the charge

sheet has been filed against Accused Nos.1 to 5 for the offences under Sections 329(4), 115(2), 118(2), 351(2), 79, 137(2) read with 3(5) of BNS. 3. Sri Peeta Raman, learned counsel for the Petitioner would submit, recording the same, the petition may be disposed of. 4. Considering the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
