101. as (Rejected) C.R.M. 5738 of 2021 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Girish Park P.S. Case No.188 of 2015 dated 01.06.2015 and charge sheeted under Sections 302/201 of the Indian Penal Code.. In the matter of : Alam Ali. …Petitioner. Mr. Joy Chakraborty. …for the Petitioner. Mr. Neguive Ahmed, ld. A.P.P., Ms. Ayantika Roy. ...for the State. Heard the learned Advocates appearing for the parties. We have considered the materials on record. Witnesses had identified the petitioner as the person who entered the house wherefrom the de-composed body of the deceased was recovered. In view of the aforesaid clinching materials on record, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, in view of the protracted period of detention suffered by the petitioner i.e. over six years, we direct the trial court to conclude the trial at an early date preferably within one year from the next date fixed before it for recording evidence without granting unnecessary adjournment to either of the parties.
