This is an application filed under Section 483 of the BNSS, 2023 praying for grant of bail for the accused/petitioner namely, Sri. Amarendra Das who was arrested on 11.05.2025 in connection with P.R.C Case No. 39/2025 U/S 3(5)/303(2)/305(b)/305(c)/306/3/17(2)/317(4)/112/61(2) of BNS, 2023. 3. The allegations as reflected in the FIR is that the petitioner was the driver of a truck carrying 300 boxes of fish which he unloaded during transit and sold the fish to nearby people. Hence the case. 4. It is submitted that the other co-accused have been already granted bail vide order dated 25.09.2025 in Bail Application No. 3037/2025. Further, the petitioner had already spent about 6(six) months behind bars and charge-sheet has already been submitted. 5. Considering the above, the prayer for bail is allowed. The petitioner namely Sri. Amarendra Das shall be released on bail of Rs. 30,000/- with 1(one) surety of the like amount to the satisfaction of Ld. C.J.M, Bongaigaon under the following conditions : (i) That the petitioner shall be available for trial if one commences ; and (ii) That the petitioner shall not hamper or tamper with the evidence. 6. Violation or breach of any condition(s) shall entail cancellation of bail. 7. With the above observations, petition stands allowed and disposed Page No.# 3/3 of accordingly. JUDGE Comparing Assistant
