Heard learned counsels for the parties.

The instant writ application has been preferred by the petitioner praying therein for the following reliefs: a) For the issuance of an appropriate writ/writs, order/orders, direction/directions upon the respondents to issue Second Merit in terms of Rue 13 of the 2001 Rules for appointment of constable list as the seats are vacant in respective districts under different categories and the petitioners herein are within the zone of
consideration for the post of constable. b) Directing the respondents to consider the case of the petitioners and issue appointment letters in their favor as they have successfully passed the medical and physical test as there are still seats vacant in their respective districts under different categories.
2025:JHHC:16497 2 c) Directing the respondents to now consider the case of the petitioner owing to the fact that their candidature was rejected earlier only for the reason that they had not scored more than the last selected candidate, whereas there are still seats vacant and the petitioners being physically and medically successful are under the zone of consideration.

At the outset, learned counsel for the petitioner fairly submits that the issue involved in this writ application is same and similar with that of W.P. (S) No. 06 of 2017 (Sunil Tudu v. The State of Jharkhand & Ors.) & analogous cases and the said cases were decided against the petitioner(s) of those cases in terms of
judgment dated 26.04.2024 passed by the Division Bench.

Accordingly, he prays that the instant writ application may be disposed of subject to the liberty to this petitioner that if the S.L.P., which has been preferred by the said petitioners before the Hon’ble Apex Court, is allowed, the petitioner may approach the concerned respondents.

Learned counsel for the respondents does not have any objection.

Accordingly, the instant writ application stands dismissed as withdrawn, subject to the liberty as prayed for. Pending I.A., if any, also stands closed.
