Both these bail applications arise out of same police case. Accordingly, they are being disposed of by a common order. Petitioners have been made an accused in connection with Rajrappa P.S. Case No.141/24, for the offence under Sections 303(2), 317(2), 317(4) and 3(5) of the BNS, pending in the Court of learned S.D.J.M., Ramgarh. On 21.08.2024 at about 10:00 P.M., Rajrappa police apprehended the petitioners alongwith co-accused persons while they were transporting some stolen materials on a pickup van. It was submitted that the petitioners are in custody for about five months. It was further submitted that the offence alleged is triable by a Court of Judicial Magistrate. Learned A.P.P.s has opposed the prayer for bail but has not disputed the aforesaid facts. Regard being had to the facts and circumstance of the case, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Ramgarh in connection with Rajrappa P.S.
