01. Upon coming of the instant bail application for consideration, the counsel for the respondent would contend that after the disposal of the petitioner’s earlier bail application by the trial court, some more witnesses have been examined by the trial court and that the petitioner can approach the trial court again for
consideration of his case for release on bail, as the trial court continues to be seized of the matter.

Learned counsel for the petitioner, on the other hand, would admit the
submissions made by learned counsel for the respondent qua the examination of further witnesses after the earlier bail application was disposed of, and, as such the counsel for the petitioner would pray for transfer of the instant bail application to the trial court for its consideration, uninfluenced by the observations made in the earlier bail application, while taking into account the statements of the witnesses recorded after the disposal of the said bail application, to which counsel for the respondent expresses no objection.
03. In view of the aforesaid submissions made by appearing counsel for the parties, the instant bail application is directed to be transferred to the Court of 01

Principal Sessions Judge, Reasi with a direction to accord consideration to the same in accordance with law uninfluenced by any observations made by it in the earlier bail application decided on 15.03.2024.
04. The instant application be considered and preferably disposed of within a period of 15 days from the date of receipt of the bail application
