1. Heard Mr. S. Roy, the learned counsel for the
Page No.# 3/3 applicant/petitioner. Also heard Mr. B. Sarma, the learned Additional Public Prosecutor appearing for the State of Assam.
2. The learned counsel for the applicant/petitioner has submitted that though the instant interlocutory application was filed by the petitioner for modification of the order dated 22.09.2025, passed in criminal petition No. 1195/2025 by this court, as the petitioner had failed to appear before the trial court in pursuant to the directions of this court due to delay in receipt of the certified copies of the said order, however, in the meanwhile, the trial court has again issued a fresh non- bailable warrant of arrest and the petitioner is intending to challenge that non-bailable warrant of arrest by filing a fresh criminal petition. Hence, he does not want to pursue this instant interlocutory application and therefore, he has prayed for allowing him to withdraw this interlocutory application.
3. The prayer is allowed.
4. The instant interlocutory application is dismissed on withdrawal.
