The present application under Section 528 of BNSS, 2023 has been filed with a prayer to quash the entire proceeding of Case No. 4368 of 2023 (State vs. Prabhunath Rajbhar and others), arising out of Case Crime No. 226 of 2022, under Sections 147, 148, 323, 307 IPC against the applicant no.1 and Section 147, 148, 323 of IPC against other applicants, P.S. Bhatni, District Deoria as well as cognizance/summoning order dated 28.03.2023, pending in the court of Additional Civil Judge (Senior Division)/F.T.C. Ist, Deoria. After some arguments, learned counsel for the applicants does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
