Heard Mr. R. A. Choudhury, learned counsel for the petitioner. Also heard Mr. A. K. Ghosh, learned Standing Counsel, Panchayat & Rural Development Department, appearing for the State Respondents and Mr. S. K. Medhi, learned Standing Counsel, AG, Assam, appearing for the respondent no.3.
2. The present writ petition has been instituted, praying for release to the petitioner his subsistence allowance from the date of his suspension. It is stated at the Bar that the petitioner after being placed under suspension, was subjected to a Department Proceeding which had culminated in the passing of the order dated 31.05.2024, imposing upon petitioner the penalty of withholding of one increment without cumulative effect. Vide the said order the Disciplinary authority had also regularized the period of suspension to be on duty for all purposes.
3. The learned counsel for the petitioner submits that the petitioner has since been released the salaries for the period of his suspension and accordingly, the grievance raised by the petitioner, in the present Writ Petition, would not mandate any further
consideration.
4. In view of the above submissions of the learned counsel for the petitioner, the present Writ Petition stands closed on having become infructuous.
