Panchayat under the YSR Jagan Anna Colony Scheme, without any notice, without any proceedings is highly illegal, arbitrary, unconstitutional, and in violation of Articles 14. 21 and 300-A of the Constitution of India and consequently direct the 2nd respondent not to interfere with the construction activity of the petitioners in Plot Nos.74 and 75 in Sy.No.827/9B of Garlamadugu Village, Pedavegi Mandal, Presently Eluru District and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 2nd respondent not to interfere with the construction activity of the petitioners’ in Plot Nos.74 and 75 in Sy.No.827/9B of Garlamadugu Village, Pedavegi Mandal, Presently Eluru District pending disposal of the writ petition and to pass Counsel for the Petitioner(S):

Heard Sri V.V.N.Narayana Rao, learned counsel for the petitioners and Sri B.V.Satyanarayana, learned Assistant Government Pleader for Revenue for respondents 1 and 2. 2.
Learned counsel for the petitioner would submit that the 2nd respondent issued house site pattas vide Patta No.WGD01212898 to the 1st petitioner and Patta No.WGD01210993 to the 2nd petitioner vide Plot Nos 74 and 75 in Sy.No.827/9B of Garlamadugu Village, Pedavegi Mandal, Eluru District. The petitioners have been in possession and enjoyment of the property. The petitioners started construction on the subject site. The 2nd respondent visited the site on 15.07.2025 and directed the petitioners orally to stop the construction, without assigning any reasons. Hence, the writ petition. 3

Learned Assistant Government Pleader, on instructions, while disputing the house site pattas of the petitioners, would submit that the 2nd respondent is not interfering with the petitioners’ possession of the respective plots. The instructions are made part of the record. 4. Given the facts and circumstances, the writ petition is disposed of, at the admission stage, with the consent of both the learned counsel, directing the learned 2nd respondent not to interfere with Plot Nos.74 and 75 in Sy.No.827/9B of Garlamadugu Village, Pedavegi Mandal, Eluru District, without following due process.
