CORAM: HON’BLE MR JUSTICE JAVED IQBAL WANI, JUDGE O R D E R 04.02.2025 Upon coming of this matter for consideration today, it came to be stated by counsel for the petitioner that at the time of rejection of the bail application filed by the petitioner earlier before the trial court, only 11 witnesses have had been examined whereafter 15 more witnesses have been recorded and that the instant bail application be transferred for consideration and disposal to the trial court on its own merits, uninfluenced by any observation made by the trial court in the earlier bail application. The prayer made by the counsel for the petitioner in principle is not being opposed by counsel for the respondent. Having regard to the aforesaid submissions of counsel for the parties, Registry is directed to transmit the record of the instant bail petition after de- registering the same to the trial court and upon receipt of the record of the instant petition, the trial court shall consider and dispose of the same in accordance with law on its own merits and uninfluenced by any observations made by it earlier while rejecting the earlier bail application of the petitioner. The trial court may make an endeavour to decide the instant bail petition expeditiously preferably within a period of 15 days from the date record is received by it. Disposed of.
