17/10/2025 None appears for the petitioner on call. Heard Mr. G Alam, learned counsel for the respondent No. 1 and Ms. S H Bora, learned Additional Public Prosecutor, Assam for the respondent No. 2.
Page No.# 2/2 Mr. G Alam, learned counsel for the respondent No. 1 submits that during the pendency of the present proceeding, the marriage solemnized between the petitioner and the respondent has been dissolved. The petitioner has divorced mutually vide order dated 26.09.2016 passed by the learned Trial Court in T.S.(M) No. 19/2016. A copy of the said order has also been placed on record. The learned District Judge, Nalbari, vide order dated 29.06.2016 had recorded the following
submissions of the learned counsel for the parties:-
“In the affidavit submitted by the parties they also reiterated the facts disclosed in the petitioner u/s 13-B. It is disclosed that the marriage has irretrievably broken down and that there is no scope for re-conciliation. It is also submitted in the affidavit that petitioner No. 1 had already paid an amount of Rs.1,00,000/- (Rupees one lakh) only as 1st installment and the petitioner No.2 on her part have already received and encashed the said amount given by the petitioner No. 1. It is submitted that both the petitioner shall jointly withdraw cases whatever pending for disposal and after the disposal of all pending cases in Nalbari Court as well as Gauhati High Court, petitioner No. 1 shall pay the 2nd installment of Rs.1,00,000/- (Rupees one lakh) only to the petitioner No. 2.” As the present revision petition is being disposed of today, the parties to comply with the undertaking made before the learned Trial Court and reflected in the order dated 26.09.2016 within a period of 1 (one) month from today. With the above observations and directions, the present revision petition stands disposed of.
