ORAL ORDER
Sri.Chinmay Kulkarni., counsel on behalf of Sri.R.Gopal., for the petitioner and Sri.Manjunatha Rayappa., AGA for respondents 1 to 4 have appeared in person.
2. The order dated:23.05.2017 issued by the first respondent vide Annexure-J is called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition.
3. Counsel for the respective parties urged several
contentions. Heard the arguments and perused the writ papers with care.
4. The petitioner contends that he is unemployed Pharmacist and resident of Davanagere is entitled for allotment of Jan Aushadhi Kendra in the first respondent Hospital. He applied and the Bureau of Pharama rejected his request. Hence he has filed the writ petition.

AGA on instruction from the District Health Officer submits that the MSIL is running the Generic Medical Shops as of today. By way of reply to this, counsel for the petitioner submits that no body is operating the Medical Shops. Counsel, therefore, submits that an appropriate order may be passed.
5. The communication dated 23.05.2017 is furnished along with the writ petition and the same is marked as Annexure-J. A perusal of the same would reflects that the petitioner's request was rejected and it was intimated to him that the government has proposed to allot to MSIL to run the Generic Medical Shops. I find no reasons to quash the communication. Because of the running of Generic Medical Shops by the MSIL as of today, nothing survives for
consideration. Hence, the writ petition is devoid of merits and same is liable to be rejected.
