THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 20396 OF 2025
ORDER:- The present Writ Petition is filed questioning the action of the Respondents in not considering the representation of the Petitioner dated 10.06.2025 as illegal and arbitrary.
2. The facts leading to the filing of the present Writ Petition are as follows:- The Petitioner was appointed as Teacher (School Assistant) on 17.09.1998 at MPPS (A.A), Peddakaburu. Thereafter, she was transferred to various places and at present, she is working in Z.P.High School (Boys), Kosigi, Kurnool District. The husband of the Petitioner is working as a Mandal Surveyor, attached to the Office of Tahsildar, Bethamcherla Mandal, which is about 80 kms from Kosigi to Yemmiganur. Therefore, the Petitioner made a representation dated 10.06.2025 to Respondent Nos. 2 and 3, requesting to transfer her to any of the nearest Mandals of her husband’s working place or to Kosigi, on spouse or on medical grounds of her son. The said request was rejected, vide Proceedings, dated 30.06.2025. It is in the above context, the Petitioner filed the present writ petition seeking for
consideration of her representation.
3. Heard Mr. Manda Venkateswara Rao,
learned counsel for the Petitioner and learned Additional Advocate General for the Respondents.
4. Learned Additional Advocate General for the Respondents would submit that as per the "Andhra Pradesh State Teachers Transfers Regulation Act, 2025 (for short, 'the Act’), the Grievance Redressal Committee constituted under Section 17 of the Act at the District/ Zonal/ State level has been under the Chairmanship of District Educational Officer/ Regional Joint Director School Education/ Commissioner/ Director of School of Education, and guidelines have been issued to the Grievance Redressal Committee to dispose of the grievances of the teachers. He further submits that the guidelines as provided under Section 17(2) of the Act have already been issued vide G.O.Ms.No.22. dated 20.05.2025. The case of the Petitioners would be considered at the earliest by the Grievance Redressal Committee.
5. Considering the above submissions, the Writ Petition is disposed of directing the Grievance Redressal Committee of Kurnool District to examine the representation of the Petitioner as expeditiously as possible and consider posting her at a place where she can attend to her familial requirements and take care of her family and self. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
