Petitioner has been made an accused in connection with Chouparan P.S. Case No. 153/2022 for the offence under sections17(c), 18(c) of the N.D.P.S. Act, pending in the court of learned Sessions Judge- cum-Spl.Judge, NDPS Act, Hazaribag. On the night of 03.06.2022, on the basis of confidential information, Chouparan police raided the house of the petitioner and seized about 52 Kgs of poppy husk from the cow shed, which was located behind the house of the petitioner. Learned lawyer for the petitioner submitted that the cow shed does not belong to the petitioner. It was further submitted that the seizure list does not bear the signature of the petitioner or any of his family members. It was further submitted that the seized contraband was not recovered from the conscious possession of the petitioner. Learned A.P.P after going through the case diary submitted that the cow shed from where the contraband was recovered was located just behind the house of the petitioner. It further appears from the case diary that the cow shed was constructed using back wall of the house of the petitioner. Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected. (Ambuj Nath, J.) Saurabh uploaded
