1. Heard the parties.
2. The present case has been filed for initiating contempt proceeding against the opposite party Nos.2 & 3 as the order dated 27.02.2024 passed by this Court in W.P.(S) No.852 of 2024 has not been complied with.
3. It has been submitted by the learned counsel for the petitioner that the person having lesser marks has been appointed and false statement has been given that there is no vacancy.

Learned counsel for the State has filed an affidavit stating that as per availability, candidates secure more than cut off marks have been called for interview and due to non-availability of the post the candidature of this petitioner could not be considered.
5. Having heard learned counsel for the parties and from perusal of the records, it appears that there is a dispute which requires determination by the Court and as such, no contempt case is made out.
6. In view of the above facts, present contempt case is hereby, disposed of giving liberty to the petitioner to work out his remedy in accordance with law.
