And 4 Others Counsel for Petitioner :- Satya Narayan Gupta,Yogendra Pal Singh Counsel for Respondent :- C.S.C. Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "1. Issue writ, order or direction in the nature of certiorari quashing the impugned order dated 28.10.2024 passed by the respondent no. 2, in Revision bearing Case No. 1485 of 2023 (Computerized Case No. C202311000001485) (Ummed Ali Vs Alfa Jenisis Services Private Limited through Jamuna Prasad), Under Section 210 of U.P. Issue writ, order or direction in the nature of certiorari quashing the impugned order dated 31.07.2023 passed by the respondent no. 3 in appeal bearing Case No. 8290 of 2022 (Computerized Case No. T202211730608290) (Alfa Jenisis Services Private Limited Amit Chhabara Vs Ummed Ali) under section 35(2), of U.P. Revenue Code, 2006." 3. Contention of the learned counsel for the petitioner is that the mutation proceedings under Section 34/35 of the U.P. Revenue Code, 2006 initiated by the respondents were dismissed. Against which, an appeal was filed and the same has been allowed and the matter has been remanded back. Against the remand order, the petitioner has filed a revision which has also been dismissed. 4. A preliminary objection has been raised by the learned Standing Counsel that since the matter is pending before the initial Authority it would be more appropriate that the petitioner may be permitted to contest the same before the Authority concerned. 5. In view of the same, I am not inclined to interfere in the matter. 6. The writ petition is disposed of with liberty to the petitioner to contest the proceedings which are pending in pursuance to the remand order. Order Date :- 18.3.2025 S.
