ELEVATED AS JUDGE 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declare the action of the Respondent no. 3 and 43 interfering with the civil disputes thereby detained the Petitioners from morning to evening and cut the plantations in an extent of Ac.1-43 cents in Survey no. 268/2A of Samcham Village, Ranasthalam Mandal, Srikakulam district is illegal, arbitrary, violation of Art. 21 and 300-A of Constitution of India and consequently direct the Respondent no. 3 and 4 not to interfere in civil dispute pending in between Petitioners and Respondent no.5 and direct the Respondent No.3 and 4 to pay damages to Petitioners the value of the plantation cut by them high handedly in an extent of Ac.1-43 cents in Survey no.268/2A of Sancham Village, Ranasthalam Mandal, Srikakulam District.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint of one Duppada Naga Raju, a case in Crime No.242 of 2019 has been registered against the Petitioners for the offences under Sections 447, 427 and 506 read with 34 IPC. It is further submitted that the Police are not interfering with the civil disputes between the parties. 3. Sri T.D.Phani Kumar, learned counsel for the Petitioners would submit that the Court may pass appropriate orders. 4. In that view, the Writ Petition is disposed of directing the Police to follow due process of law regarding the crime registered against the Petitioners. Police are further directed not to interfere with the civil disputes between the Petitioners and Respondent No.5. There shall be no order as to costs.
