BEFORE HON’BLE MR. JUSTICE RAJESH MAZUMDAR 26.11.2025 Heard Mr M Hussain, learned counsel appearing for the petitioners. Also heard Ms M Barman, learned Government Advocate, Assam, appearing for the respondent Nos. 4 and 5; Mr A Chaliha, learned Standing Counsel, Finance Department; appearing on behalf of the respondent No. 2; and Ms R H Choudhury, learned Standing Counsel, ASLSA, appearing on behalf of the respondent Nos. 1 and 3. 2. The grievance in this writ petition is that although an order was passed by the District Legal Services Authority, Dhubri, on 21.02.2025 in Victim Compensation Registration No. 18/2024, entitling the petitioners to be paid the following amounts:
1. Rs. 3,00,000/- (Rupees Three Lakhs Only), be paid to Pratibha Ray, the wife of the deceased. 2. Rs. 1,00,000/- (Rupees One Lakh Only) each be paid to the younger daughter Moromi Ray and the son Amarendra Ray. And an amount of Rs. 5,00,000/- (Rupees Five Lakhs Only) be paid to Nibaran Ray, the son of deceased Anhita Ray, the same had not been paid. Page No.# 3/3 The entitlement of the petitioners to the aforesaid amounts is not in dispute. 3.
Today, the learned counsel for the petitioners has also placed his reliance on the order dated 24.11.2025, passed in WP(C) No. 6036/2025, whereby the respondents were required to release and disburse the compensation amount, as per the order referred to, therein. 4. The learned counsels for the parties are in consonance that a similar order would suffice the requirements of this writ petition also. 5. Accordingly, the respondents are directed to release and disburse the compensation amount, as reflected in the order dated 21.02.2025 to the petitioners and other entitled persons mentioned in the order itself, within a period of 3 (three) months from today. The respondent Nos. 3, 4 and 5 shall complete any requisite formalities within a period of 2 (two) weeks from today and the respondent No. 2 shall take appropriate steps for sanction etc. of the compensation amount within a period of 4 (four) weeks, thereafter. 6. Writ petition, accordingly, stands disposed of. JUDGE Comparing Assistant
