GP FOR SERVICES I The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.20520 of 2025 O R DE R: The present Writ Petition is filed questioning the inaction of the Respondents in not granting the terminal benefits to the Petitioners being the successors of late A. Dadapeer as illegal and arbitrary. 2. Sri A. Dadapper, the deceased, was appointed as Office Subordinate (Class-IV) in the office of the District Collector, Ananthapur. While so, the individual had expired on 10.03.2022 leaving behind the Petitioners i.e., the wife and son. In spite of passage of time, no terminal benefits were being given to the Petitioners in spite of their Representations dated 10.05.2022 and 22.09.2022. In that context, the present Writ Petition is filed for grant of terminal benefit of late A. Dadapeer and also to consider the case of Petitioner No.2 for compassionate appointment. 3. Learned Assistant Government Pleader would submit the Service Register of the deceased does not contain the names of Petitioners as legal representatives and therefore, the 3 Respondents are unable to process the terminal benefits. He further submits that if a Succession Certificate is produced by the Petitioners in accordance with the provisions of Indian Succession Act, 1925, the Respondent Authorities will process the claims of the Petitioners towards release of terminal benefits and pension and considering the case of Petitioner No.2 towards compassionate appointment. 4. Having heard the respective counsel, this Court is of the opinion that there is justification in the stand taken by the Respondents for not releasing the terminal and pensionary benefits to the Petitioners as the Service record of the Deceased does not contain the name of the Petitioners. 5. Accordingly, the Writ Petition is disposed of leaving it open to the Petitioners to seek for declaration that they are the successors of the estate of late A. Dadapeer under Indian Succession Act. On producing the Succession Certificate, the Respondent Authorities shall process the claims of the Petitioners for release of terminal and pensionary benefits. The Respondents shall thereupon consider the case of the 4 Petitioner No.2 for compassionate Appointment also. There shall be no order as to costs.
