By means of this petition filed under Article 227 of the Constitution, petitioner is seeking expeditious disposal of Execution Case No.- 01 of 2022 (Jyoti Agarwal & Others v. Kailash Agarwal) arising out of Rent Case No. 40 of 2016, pending before the court of Judge, Small Cause Court, Jhansi. Learned counsel for the petitioner submits that in the aforesaid case a sub-tenant has also moved an application under Order 21 Rule 97 C.P.C. which has also not been disposed of. In view of the above, this petition stands disposed of with following directions: a) The endeavour of the court will be to first dispose of the pending application under Order 21 Rule 97 C.P.C. within a period of one month from the date of production of certified copy of this order after giving full opportunity of hearing to the parties to execute the proceedings. b) After disposal of the application under Order 21 Rule 97 C.P.C., if the execution case survives, the court will proceed to decide the execution case giving full opportunity of hearing to the parties within a further period of two months.
