Heard Sri Rishabh Agarwal, learned counsel for the petitioner. By means of this petition filed under Article 227 of the Constitution, petitioner is seeking expeditious disposal of P.A. Execution Case No.- 04 of 2023 (Ramkishan Sahu v. Prema Devi & Ors) arising out of P.A. Case No. 50 of 2014, pending before the court of Judge, Small Cause Court, Jhansi. Learned counsel for the petitioner submits that no misc. case is pending in the execution proceedings and the judgment debtor has appeared. Even the judgment debtor/ tenant has filed affidavit stating before the executing court that he would be vacating the premises within six months which has already been expired in the month of October, 2024 and yet the premises have not been vacated. In the given facts and circumstances of the case, this petition stands disposed of with directing to the executing court to decide the Execution Case No. 04 of 2023 within a period of six weeks from the date of production of certified copy of this order after giving full opportunity of hearing to the parties to execute the proceedings.
