1. Heard Mr. M.H Barbhuyan, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Additional Public Prosecutor for the State of Assam.

This is an application filed under Section 483 of the BNSS, 2023 praying for grant of bail for the accused persons/petitioners namely, (1) Sirajul Islam @ Hoque, (2) Sekandar Ali @ Seken Ali who were arrested on 21.07.2025 in connection with Barama P.S Case No. 61/2025 U/S 310(2) of BNS, 2023 and added Sections of 111(2)/111(3)/111(4)/140(2)/317(3)/61(2)/310(5)/310(6) of BNS,

3. The allegation in the FIR dated 16.07.2025 is dacoity upon truck bearing registration No. RJ09QE6232 carrying pan masala of Rs.80 lakhs. Hence the case.
4. It is submitted by the learned Additional Public Prosecutor that in the meantime upon completion of Investigation charge-sheet has been submitted in the case. In this context learned counsel for the petitioner submits that some co-accused have already been granted bail by this Court on the said ground of completion of investigation.
5. In the aforesaid facts and circumstances this bail petition is allowed. The accused persons/petitioners, named above, shall be released on bail of Rs.30,000/- each with one suitable surety each of
Page No.# 3/3 like amount to the satisfaction of Eleka Magistrate, subject to the following conditions that the accused persons/petitioners : (i) shall not abscond. (ii) shall be available for trial. (iii) shall not hamper tamper the investigation or with the evidence. (iv) shall not misuse their liberty to commit any illegal acts or offences.
6. Accordingly, this bail application stands allowed and disposed of.
