ORDER: The petitioners are challenging the inaction on part of the respondents in not giving weightage marks for the service rendered by the petitioners in accordance with the Notification No.2/2019, dated 27.07.2019. A consequential direction to the respondents to appoint the petitioners as ANM/MPHA in their Districts together with consequential benefits. 2. The state introduced the Village Secretariate System vide GOMs.No.110, dated 19.07.2019. A notification dated 27.07.2019 issued for filling up the posts of ANM/MPHA(F). Total number of 13540 vacancies were notified. The notification has prescribed relaxation for in-service candidates. Weightage marks are also prescribed for categories of contract employees and it is submitted that all the petitioners are eligible for the weightage marks as per the notification. It is submitted that the respondents have not extended the weightage marks for the petitioners though they are entitled to as per the notification. was age
3. The learned counsel appearing for the petitioners submits that during the pendency of the writ petition some of the petitioners were granted weightage marks and some of the petitioners were

It is submitted that candidates who applied in Ananthapuram and Visakhapatnam Districts were extended the weightage marks and the selected candidates were also given due appointmentorders. Candidates from Srikakulam and other regions were not granted the weightage marks. 4. The learned Government Pleader appearing for the respondents submits that as per the notification the online application was to be submitted by the applicants. The petitioners who did not fill up the service particulars in their application(s) submitted online their application(s) could not be considered for award of weightage marks. It is submitted that the respondents cannot be held responsible for the mistakes committed by the applicants while filling up their online application(s). It is also submitted that unless and until the respondents are informed of the particulars of service of the petitioners as on the date of submission of application, the respondents cannot be expected to suimoto grant weightage marks without any basis. It is submitted that some of the petitioners could not be selected on account of their inability to qualify in the written examination. The learned Government Pleader on instructions submit that the petitioner Nos.7, 28, 29, 30 and 31 were selected and are also working. It is submitted that the petitioner Nos.1, 3, 4, 5, 11 and 12 were also selected.

WP.No. 18726 of 2019 submitted that weightage marks were duly extended to all the petitioners who were eligible and some of the applicants’ inspite of grant of weightage marks could not qualify in the written examination and as such their cases for selection were not considered. 5. Heard the learned counsel for the petitioners and the learned Government Pleader for respondents and perused the material on record. 6. The respondents have duly extended the weightage marks for in- service candidates who have submitted the relevant details along with their online application form. The respondents have also granted weightage marks for the candidates who applied in Ananthapuram and Visakhapatnam Districts. During the pendency of the writ petition it is submitted that weightage marks were extended to all those who were found eligible. Considering the
submissions it cannot be disputed that the applicants who did not qualify in the written examination can claim for the regular posts only on account of their weightage marks. The only issue is left for
consideration is non-granting of weightage marks to the applicants who qualified in the written examination and on account of non granting of such weightage marks they could not find place in the final selection list.
II5II WP.No.18726of2019 respondents have granted weightage marks in some districts denied granting weightage marks in some districts. Such irrational acts of the respondents paved way for filing of the writ petition. The respondents are hereby directed to grant weightage all those eligible candidates and consider their cases for appointment to the post of ANM/MPHA(F). In the event the recruitment is over vacancies for accommodating the eligible petitioners, their cases denied grant of weightage marks on account of the failure to submit their in-service details, their cases be considered by the respondents in the next proposed recruitment. rjkv
