Hon'ble Saral Srivastava,J. 1. Heard Sri Awadhesh Kumar Malviya, learned counsel for the petitioners and learned Standing Counsel for the State. 2. The petitioners by means of the present writ petition have assailed the order dated 18.01.2025 whereby the Assistant Registrar, Firms, Societies & Chits, Azamgarh Region, Azamgarh has invoked the power under Section 25(2) of the Societies Registration Act, 1860 for holding the election and has also finalized the list of members of the Society. 3. Challenging the impugned order, learned counsel for the petitioners has contended that petitioners are the members of the Society yet their name have been removed from the list of Electoral College/General Body. It is submitted that the provisional list of members was published by the Assistant Registrar by order dated 27.05.2024 in which petitioners' name did not find place, and accordingly, petitioners raised objection and the Assistant Registrar while passing the order dated 18.01.2025 did not consider the objection of the petitioners, therefore impugned order cannot be sustained in law being non-speaking and without application of mind. 4. Be that as it may, so far as the petitioner no.2-Gama Yadav and petitioner no.3-Shivchand Gupta are concerned, their names find place in the provisional list of membership as well as final list of Electoral College/General body published alongwith the order dated 18.01.2025, and therefore, they have no cause of action to challenge the list of membership. 5. So far as petitioner no.1-Suresh Yadav and petitioner no.4- Tufani Yadav are concerned, the record does not reflect that Tufani Yadav had filed any objection. It is only Suresh Yadav, who has filed objection against the provisional list which has been appended at page 74 of the paper book. The objection of Suresh Yadav appending at page 74 is reproduced herein below:- " ससवव मम, शशमवनन सहवयक ननबनधक फरसर सससवइटश एवव नचटस आजमगढ। नवषयय- पतववलश 1-31488 मम आदसश नदनववक 27.05.2024 पर आपतत हम पवरर ननरन आधवरर पर पसततत हह :- 1. यह नकव आदसश नदनववक 27.05.2004 अवहध रप सस पवररत हह। 2. यह नक आदसश नदनववक 27.05.2024 दवरव पबनध सनमनत कस नदनववक 15.10.2018 कस कवलवनतत घसनषत करतस हहए सवधवरण सभव कक ससचश वषर 2015-16 सस चतनवव करवनस कव आदसश नदयव गयव हह। 3. यह नक ददरवन सतनववई पकर दवरव यह सवशकवर नकयव गयव हह नक सवसरव कव अननतम चतनवव जस वषर 2018 कस हहआ तजस पर कसई नवववद नहश हह, जस सवयव मम शश रवमलखन तसवह दवरव पसततत हह यवनन नक पसवर अधयक शश गतनरवज तसवह कक अधयकतव यस चयननत पबनध सनमनत व सवधवरण सभव पर पकर कस कसई आपतत नहश हह। 4. सवसरव ननयमववलश कस अनतसवर कवयरकवल तशन वषर कव हह यवनन कमसटश नदनववक 13.10.2021 तक वहध हह। 5. यह नक सपष तरशकस सस पकर कस यहवह सवशकवर हह। इसतलए रवमलखन तसवह दवरव पसततत ससचश वषर 2018-19 कस वहध सदसयर कक ससचश मवनतस हहए ससचश वषर 2018-19 कस आधवर पर चतनवव करवयव जवय। अतय आप शशमवनन जश सस नवनम ननवसदन हह नक सवसरव नहत मम पबनध सनमनत एवव पबनधक कव चतनवव करवनस कक कक पव करम।" 6. Perusal of aforesaid objection reveals that there is no averment in the objection of respondent no.1 that as to when he was enrolled as member nor did he enclose any record indicating that he has been validly inducted as member of the Society namely 'Sri Brahm Baba Junior High School Hemai, Amila District Mau'. 7. Since there was no material before the Assistant Registrar regarding the induction of petitioners being members, therefore, there was no occasion for the Assistant Registrar to return a finding that Suresh Yadav has wrongly been removed from the list of Electoral College/General Body. 8. So far as the petitioner no.4-Tufani Yadav is concerned, since he did not raise any objection against the provisional list inasmuch as there was nothing on record to indicate that he has filed any objection against the provisional list, therefore, writ petition on his behalf is misconceived. 9. Thus, for the reasons given above, the writ petition lacks merit and is hereby dismissed with no order as to costs.
