The Court made the following Order:
The present Civil Revision Petition is filed aggrieved by the order, dated 19.04.2022, passed in E.P.No.160 of 2018 on the file of the learned Principal Senior Civil Judge, Nellore. The petitioners are judgment debtors in the said Execution Petition. The respondent/decree holder filed Execution Petition under Order 21, Rules 37 & 38 of C.P.C., seeking to arrest the judgment debtors and detain them in civil prison for realization of the decreetal amount. 2. It is a specific case of the respondent/decree holder that, despite having sufficient means, the petitioners did not choose to pay the decretal amount. After considering the case, the Executing Court allowed the Execution Petition observing that the judgment debtors are having sufficient means to pay the decretal amount. 3.
At the time of admission, this Court, by an Order, dated 11.08.2022, while suspending the order impugned, directed the petitioners to deposit 50% of the E.P. amount within a period of three (03) weeks from the date of the
order.
4. When the matter was taken up for hearing, both the learned counsel represented that, the interim order is complied with. Further, the learned counsel for the petitioners requested to grant reasonable time to deposit the remaining 50% of the decretal amount.
