Subsequently, during the pendency of the writ proceedings, the Respondent Bank issued a communication dated 02.06.2025 canceling the OTS proposal. The Petitioner is now intending to challenge the said cancellation order separately in accordance with law. In light of the above developments, the present writ petition has become infructuous and the - 3 - HC-KAR NC: 2025:KHC:22379 WP No. 15833 of 2025 Petitioner seeks leave of this Hon'ble Court to withdraw the same, with liberty to challenge the subsequent communication/order dated 02.06.2025 issued by the Respondent Bank. WHEREFORE, the Petitioner most respectfully prays that this Hon'ble Court may be pleased to permit the Petitioner to withdraw the above Writ Petition as having become infructuous; and Reserve liberty to the Petitioner to challenge the subsequent communication/order dated 02.06.2025, in accordance with law; In the interests of justice and equity." 2.
