JUSTICE NELSON SAILO ORDER Date : 19-12-2025 On 18.12.2025, Court passed the following order: “The authority of the District Commissioner, Barpeta, to suspend the petitioner, Page No.# 2/2 who is the In-Charge Head Master of Kayakuchi Pathar M. E. School, as well as show- cause notice issued to him by the Additional District Commissioner (Education), Barpeta are under challenge in this writ petition. Mr. S. Borthakur, learned counsel for the petitioner submits that the impugned orders are in clear violation of Rules 6(1) of the Assam Services (Disciplinary and Appeal) Rules, 1964. Mr. G. Pegu, learned Govt. Advocate submits that he has instructions to seek for four days time so that para-wise comments/instructions can be prepared. However, having regard to the nature of the allegation made, let the matter be listed again on 19.12.2025.” Today Mr. G Pegu, learned Additional Senior Government Advocate submits that he has received instructions, which is to the effect that the order of suspension has been revoked vide order dated 12.12.2025. In support of his submission, he has produced the copy of the said order which shall be retained on record and marked as ‘X’ for identification.
