THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE HEMANT CHANDANGOUDAR ORAL ORDER The petitioner challenges the order passed by the trial Court confirm by the Learned Sessions Court wherein maintenance amount of Rs.13,000/- was granted to the respondents as a monthly maintenance. 2. The parties are present before this Court and filed a joint memo stating that they have amicably resolved the dispute among themselves and in terms of the settlement the marriage has been dissolved mutually in MC.No.37/2019 and the petitioner has aggrieved to pay a sum of Rs.17 lakhs towards permanent alomany and the respondent no further claims against the petitioner. She further stated that she has no objection for quashing the impugned order. The demand draft of Rs.17 lakhs is - 3 - NC: 2025:KHC:18108 CRL.P No. 6292 of 2024 handed over to the respondent, is present before this Court and same is acknowledge subject to realization. 3. Joint memo is placed on record. 4. In view of the amicably settlement between the parties the impugned order are liable to be quashed. The respondent are also agreed to withdraw the proceedings in relation to recovery of arrears of maintenance. ORDER i. Accordingly, petition is allowed. ii. The impugned order dated 12.03.2024 passed by the V Addl. District and Sessions Judge, Shivmogga at Sagar in Crl.RP.No.10008/2023 and the judgment dated 27.12.2022 passed by the Senior Civil Court and JMFC Soraba in Crl.M.No.118/2019 are hereby quashed and the application is filed under Section 125 of the Cr.P.C., is dismissed.
