THE PAY AND ACCOUNTS OFFICER, WORKS ACCOUNTS, KADAPA, Y.S.R DISTRICT. ...RESPONDENT(S): 2 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondents in paying the net amount of Rs. 10,40,156 /- (Ten Lakhs Fourty Thousand One Fifty Six Rupees Only) which was pending through CFMS No.2023-2448119 and net amount of Rs. 17,36,745/- (Seventeen Lakhs Thirty Six Thousand Seven Hundred Forty Five Rupees Only) which was pending through CFMS No.2023- 2430023 which is a total of Rs.27,76,901/- ( Twenty Seven Lakhs Seventy Six Thousand Nine Hundred and one Rupees Only) for the work executed by me as arbitrary, illegal and well established legal principles apart from being violative of the fundamental and Constitutional rights guaranteed to me under Articles 14, 19, 21 and 300- A of the Constitution of India and consequently direct the respondents pay the amount of Rs.27,76,901/- ( Twenty Seven Lakhs Seventy Six Thousand Nine Hundred and one Rupees Only) forthwith and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents to take necessary action for payment of an amount of Rs.27,76,901/- (Twenty Seven Lakhs Seventy Six Thousand Nine Elundred and one Rupees Only) forthwith for which the petitioner is entitled to, pending disposal of the above Writ Petition and pass Counsel for the Petitioner: 1. GP FOR FINANCE PLANNING 3 The Court made the following Order: Learned counsel for the petitioner submits that the petitioner has executed works as entrusted by the 3rd respondent-Corporation and submitted final bills. It is submitted that the competent authority has also recorded the progress of work and certified the work in the M-Book. It is submitted that, in all, an amount of Rs.27,76,901/- is due and payable by the respondents to the petitioner. It is submitted that the bills were also uploaded in the CFMS Portal. However, no amounts have been forth coming. 2. Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Municipal Administration and Urban Development for the 1st respondent; the learned Assistant Government Pleader for Finance and Planning, for the respondents 2 and 5 and the learned Standing Counsel for the respondents 3 and 4. 3. Considering the submissions, the respondents 2 to 5 are hereby directed to verify and release the payments due payable to the petitioner as expeditiously as possible preferably within a period of six (6) weeks from the date of receipt of a copy of this order. 4.
