1. Heard Mr. A Ahmed, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Addl. Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the B.N.S.S, 2023 praying for grant of bail for the petitioner namely, Rubin Alam in connection with Morigaon P.S Case No. 245/2025 U/S 303(2) of B.N.S,

3. The petitioner has been shown arrested in this case on 27.10.2025. Earlier he was arrested in connection with Morigaon P.S Case No. 254/2025 where he was granted bail by this Court by order dated 25.11.2025 in Bail Application No. 3697/2025. Thereafter, he was shown arrested in the present case. 4. The brief facts of the case is that on 02.09.2025 the Superintendent STHG Civil Hospital, Morigaon lodged an FIR before O/C Morigaon P.S. alleging inter alia that Janani Surakha Yojna (JSY) payment of Rs. 2,100/- were made from their hospital to the pregnant woman who delivered at their hospital. For such payment they collect the JSY card, discharge slip, bank passbook and ANC card etc and prepare the APR (Actual Payment Receipt) for final payment of JSY through PFMS payment software (Gol). The enclosed documents were kept in voucher files for future audit. The collection of JSY card, discharge slip, bank passbook from the pregnant woman was entrusted to Mr. Rabin Alom, a Grade IV employee under HMC) as per verbal instruction. Said Rabin Alom prepares the list of JSY beneficiaries, maintains the JSY payment vouchers and kept in a separate room for audit purpose but said Rabin Alom had been absconding and his mobile number is switch off prior to the day of lodging of the FIR. Hence, the case. 5. It appears from the order dated 12.11.2025 in Bail Application No. 532/2025 passed by the Ld.
District & Sessions Judge, Morigaon granting bail to the accused that charge-sheet has already been submitted and keeping in view the same, the further detention of the co-accused was not considered to be necessary and accordingly, the co-accused was granted bail. 6. Having regard to the above and also the principle of parity, the present petitioner also deserves to be released on bail. 7. Accordingly, the prayer for bail is allowed. Page No.# 3/3
8. The above named petitioner shall be released on bail on furnishing a bail bond of Rs. 50,000/- with 1(one) local surety of the like amount to the satisfaction of the concerned Ld. Trial Court. 9. It is further provided that the petitioner (i) shall not abscond. (ii) shall be available for trial. (iii) shall not hamper tamper the investigation or with the evidence.
