1. Heard Mr. Akhtar Hussain, counsel for the petitioner and Mr. Hari Om Rai, Panel Lawyer for the Respondent/State. 2. The present petition has been filed by the petitioner with the following prayer:
"It is therefore, payed that this Hon'ble Court may kindly be pleased to allow this petition and quash the entire charge-sheet filed in connection with Crime No. 73/2023, under Section - 498-A, 34 of I.P.C. registered at police station- Mahila Thana, Bilaspur (C.G.) and also quashing of proceeding of Criminal Case No. 10140/2023 pending before JMFC, Bilaspur, District Bilaspur (C.G.), in the interest of justice."
3. At the time of hearing, this Court has observed that the charge has been framed on 17.05.2024 but the petitioner has not challenged the charge and order framing charge and the petition is filed without challenging the order of taking cognizance in the present petition. 4. In such a situation, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a duly constituted petition. 5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty with a cost of Rs.
3,000/- to be deposited in the account of Government School for Visual and Hearing Impaired, Tifra, District Bilaspur within 7 days from today and furnish the receipt of the same before the Registry of this High Court. Sd/- Sd/-
