06.08.2025 Court No.28 Item No.25 tbsr Reject CRM (A) 1924 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 corresponding to Section 438 of the Code of Criminal Procedure, 1973 in connection with Moyna P.S. Case No.279 of 2020 dated 17.10.2020 under Sections 420/409/468 of the Indian Penal Code, 1860. And In the matter of: Somnath Das ….Petitioner. Mr. Sabir Ahmed Ms. Tasnim Ahamed Mr. Shraman Sarkar Mr. Ezaz Ahmed Mr. Dhiman Banerjee
….for the petitioner Mr. Ranadeb Sengupta Mr. Asraf Mondal
…..for the State
Heard the learned counsels for the parties.
Perused the case diary.
The State has alleged that the petitioner was the Manager of a Co- operative Bank. He collected money as contributions from several customers, but did not deposit the same and defalcated the sums. An audit report found that for huge amounts, there was no withdrawal slip of depositors or document regarding crop damage claim disbursement.
Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
