This interlocutory application has been preferred by the applicant for substituting their names in place of the original-petitioner, Pramod Yadav who died on 12.01.2022.

Learned counsel for the respondent does not have any objection.

Having regard to the aforesaid submission and looking to the averments made in this application, I.A. No. 5899 of 2023 stands allowed.

Learned counsel for the petitioner is directed to insert the name of the applicants in place of the original petitioner in course of the day.
With request of both the parties, the main writ application is being taken up today itself for hearing.

The instant writ application has been preferred by the petitioners for issuance of the appropriate writ(s), Rule(s), direction(s) on a writ in nature of certiorari for quashing the letter no. 1285 dated 23.12.2011 Annexure-5 under the signature of Audit Officer, Vinoba Bhave University, Hazaribagh, Assistant Director, Vinoba Bhave University, Hazaribagh, Deputy Director, Vinoba Bhave University, Hazaribagh, Deputy Secretary, Vinoba Bhave University, Hazaribagh, for regularisation change from 01.08.1993 to

11.12.77. AND/OR; For issuance of an appropriate writ(s), Rule(s) Direction commanding upon the respondents no.6 to rectify the anomalies in pay of pay Scale and fix the pay on direction passed by Co-ordinator to registrar vide letter no. VBU/ B.P. 139/16 dated 05.02.2016 for the aforesaid purpose. AND/OR; For the issuance of any other appropriate writ(s), Rule (s),
order(s) Direction (s) as your lordships may deem fit and proper under the facts and circumstances of the case for imparting complete and substantial justice to the petitioner.

Learned counsel for the petitioner submits that though the original-petitioner was fully entitled for the prayer made in the instant writ application; however, in spite of repeated representations, his grievance was not redressed during his life time.

Learned counsel for the respondent-University fairly submits that if the present petitioners shall file a fresh representation before the concerned respondent he will look into the matter and pass an appropriate order.
8. Having regard to the aforesaid submissions, without going into the merits of the case, the instant writ application is hereby disposed of, by directing the Respondent No.6 to

treat this writ application as representation and take a decision with regard to the grievance of the original Petitioner, who died during pendency of this case, in accordance with law and applicable Rules and Regulations by passing a reasoned and speaking
order; and any admitted dues/allowable monetary benefits shall be paid to the present petitioners.
The entire exercise shall be completed within a period of 16 weeks from the date of receipt of a copy of this order. The present petitioners shall serve the copy of this writ application along with this order to the Respondent No.6 for early disposal of their grievance.
9. With the aforesaid observations and directions, the instant writ application stands disposed of.
