JUSTICE SANJAY KUMAR MEDHI ORDER 26.11.2025 None appears for the petitioner on call whereas Shri SMT Chistie, learned counsel is present for the respondents. Even on the last occasion i.e. 17.11.2025, there was no representation on behalf of the petitioner. This petition was instituted complaining deliberate and willful disobedience of the order of this Court dated 19.05.2016 passed in WP(C)/5525/2007. Shri Chistie, learned counsel for the respondents has, however, submitted that as per a policy decision, the petitioner and similarly situated persons have been offered the appointment as Tutor and the petitioner in the instant case has accepted the said appointment. He has also submitted that as a condition of such appointment, the arrear salaries cannot be claimed and in this regard, the learned counsel has placed before this Court a copy of communication dated 13.01.2022 along with enclosures issued by the Director of Elementary Education, Assam, Kahilipara. In view of the aforesaid development, this Court is of the opinion that there is no requirement to continue with this proceeding any further which accordingly stands closed. A copy of the communication dated 13.10.2022 along with its enclosures is made a part of the records. JUDGE Comparing Assistant
