Mr. Bilal Ahmed, learned counsel for the applicant. 2. Mr. V.S. Pal, learned A.G.A. along with Mr. Prabhat Kandpal and Mr. Rakesh Negi, Brief Holders for the State. 3. The present applicant “Afroz Alam” is seeking bail in relation to Case Crime No. 26 of 2025 registered on the basis of the FIR dated 13.01.2025, P.S. Patel Nagar, District Dehradun, wherein, the present applicant has been implicated for the offence punishable under Section 303(2) r/w Section 62 of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and is languishing in jail since 15.01.2025 and furthermore he was never been previously convicted. 5. Learned A.G.A. Mr. V.S. Pal on written instructions informed to this court that the applicant have the criminal history of the same nature. 6. Apart from this, learned A.G.A. Mr. V.S. Pal also informed to this court that after examining the CCTV footages the applicant was implicated. 7. After taking into consideration that the applicant has a criminal history, it appears that the applicant is habitual offender. 8. Accordingly, I do not find any merit in the present bail application. 9. Consequently, without expressing any opinion on the merit of the case the bail application is dismissed.
