Heard Mr. N. Mahajan, learned counsel for the petitioner and Mr. K.K. Parashar, learned Additional Public Prosecutor for the State is present. This is an application under Section 482 of the BNSS, 2023 Praying for grant of pre-arrest bail to the accused/ petitioners, namely, 1. Bisheswar Barman, 2. Bikram Barman and 3. Bidyut Barman, who are apprehending arrest in connection with Bijni P.S. Case No. 70/2025. The learned Additional Public Prosecutor has submitted that charge sheet has been submitted in this case vide C.S. no. 106/2025, dated 29.09.2025. The
learned counsel for the petitioner has submitted that 01.09.2025, passed in AB No. 1610/2025, whereby the interim protection granted to the main accused have been made absolute and the conditions provided in the said order were required to be complied by the petitioner without fail. In the present case it is seen that the petitioners are the father and brothers of the Bidya Barman, who was petitioner in AB/1610/2025. It is seen that by an order dated 23.07.2025, the petitioners herein were also granted interim protection subject to conditions laid down in the order itself. The statement have been made that the petitioner also appeared and their statement have been recorded. Accordingly, further custody is not required. In view of the above interim protection granted to the petitioners by order dated 23.07.2025 is hereby made absolute.
