Heard Mr. A.N. Sarma, learned, learned counsel for the applicant-writ petitioner and Mr. H. Baruah, learned counsel representing Mr. B. Gogoi, learned Standing Counsel, Finance & Taxation Department for all the respondents. 2. The instant interlocutory application is preferred by the applicant for striking down the name of the petitioner no. 2 from the array of petitioners in the accompanying writ petition, W.P.[C] no. 4056/2018. The applicant as petitioner no. 1 herein along with one Rumena Rahman as petitioner no. 2 had preferred the accompanying writ petition assailing a Notice dated 18.05.2018 issued by a Certificate Officer [Taxation], Guwahati. 3. The applicant has averred that during the pendency of the writ petition, the petitioner no. 2, namely, Rumena Rahman expired on 21.02.2020. Therefore, an occasion has arisen to delete the name of the petitioner no. 2 from the array of petitioners in the accompanying writ petition, W.P.[C] no. 4056/2018. The applicant has further submitted that he as the remaining the petitioner would pursue the accompanying writ petition as the right to sue still survives. 4. Mr. Baruah, learned counsel appearing for the opposite parties has submitted that he has no objection if the name of the petitioner no. 2 is deleted from the array of petitioners in the accompanying writ petition due to her death. 5. As the petitioner no. 2 in the accompanying writ petition has expired on 21.02.2020,
Page No.# 3/3 the instant interlocutory application is allowed. 6. The applicant as the sole surviving petitioner shall file an amended Cause-Title before the Registry as per the Notification no. 79 dated 19.06.2023 within 3 [three] working days from today.
On filing of the amended Cause-Title, the Registry shall carry out the necessary correction in the Cause-Title as well as in the CIS. JUDGE Comparing Assistant
