Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue Writ, order or directions more particularly one in the nature of Writ of Mandamus to declare the action of Respondents No.3 and 4 incorporating the name of Respondent No.5 in Revenue records pertaining to lands to an extent of Ac.6.00 Cents in Sy.No.ll2 of Paidipala Village, Makavaripalem Mandal, Anakapalli District, as illegal, arbitrary, high handed and violation of Provisions of Andhra Pradesh Rights in Lands and Pattadar Pass Book Act, 1971 and Rules there Under and Violation of Article-14, 21 and 300-A of The Constitution of India and consequently direct the Respondents No.3 and 4 not to incorporate the name of Respondent No.5 in Record of Rights pertaining to land to an extent of Ac.6.00 Cents in Sy.No.ll2 of of Paidipala Village, Makavarapalem Mandal, Anakapalli District and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents No.3 and 4 not to mutate the name of the Respondent No.5 in Record of Rights pertaining to land to an extent of Ac.6.00 Cents in Sy.No.ll2 of of Paidipala Village, Makavarapalem Mandal, Anakapalli District, pending disposal of the above Writ Petition and pass Counsel for the Petitioner:

Heard learned counsel for the petitioner and Sri B V Satyanarayana, learned Assistant Government Pleader for Revenue for respondents 1 to 4. Notice in respect of the 5th respondent is dispensed with since no adverse
order is passed affecting its rights and interests.

Learned counsel for the petitioner would submit that the petitioner and his two brothers are the absolute and possessors of Ac.6-00 cents in S.No 112 of Paidipala Village, Makavaripalem Mandal, Anakapalli District. The

petitioner, along with his brothers, filed O.S.No.3 of 2024 on the file of the Civil Judge (Senior Division), Narsipatnam, seeking a declaration of title and perpetual injunction. The 5th respondent also filed suit O.S.No.468 of 2023 on the file of the Civil Judge (Junior Division), Narsipatnam, for perpetual injunction. Both suits are pending. The 5th respondent approached the 4th respondent to survey the subject land. The petitioner also made a representation objecting to the survey of the subject land. The petitioner also issued a legal notice dated 30.04.2025, not to make any changes in the record of rights pending disposal of the suit and filed the above writ petition.

Learned Assistant Government Pleader submitted the instructions of 4th respondent-Tahsildar and would submit that the authority has not received any application regarding updation of the Record of Rights in respect of Ac.6- 00 cents in Sy.No.112 of Pidipala Village, Makavarapalem Mandal, Anakapalli District. Learned AGP also would submit that the Tahsildar will follow the procedure mandated under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short “the Act”) and the Rules made thereunder.
4. Given the facts and circumstances of the case, the Writ Petition is
disposed of at the admission stage with the consent of learned counsel on either side directing the learned 4th respondent-Tahsildar to adhere the procedure mandated in the Act, 1971 and the Rules made thereunder in respect of Ac.6-00 cents in Sy.No.112 of Pidipala Village, Makavarapalem Mandal, Anakapalli District as expeditiously as possible. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
