The present appeal is directed against impugned judgment of conviction and order of sentence dated 08.02.2013 passed by the Special Judge (N.D.P.S.), Korba, District Korba (C.G.) in Special Criminal Case No.03/2012, whereby and whereunder, the appellant stands convicted under Section 20(2)(B) of the N.D.P.S. Digitally signed by VIJAY BHARATRAO PEKDE 2 Act and sentenced him to undergo S.I. for 01 years with fine of Rs.10,000/-, plus default stipulation. 2. Non-bailable warrant issued against the appellant received unserved with a report of S.H.O. Police Station – Darri, District Korba (C.G.) that appellant – Sunderlal Kurmi left for heavenly abode on 14.06.2019. The report of the S.H.O. is duly supported by the affidavit of daughter of appellant and panchanama executed by the Councillor, Nagar Palika Nigam, Korba (C.G.). 3. Learned State counsel has also verified the aforesaid fact and confirmed the death of sole appellant. 4. Thus, in view of the death of sole appellant and in absence of any application for bringing his legal representatives on record to prosecute the appeal, the appeal abates and the same is dismissed as abated. 5.
