ORAL JUDGMENT

Heard learned advocate Smt. S.M. Anitha Patil for learned advocate Mr. K. Ravi Shankar for the complainant and learned Additional Government Advocate Smt. Pramodhini Kishan for the respondents.

Before learned Single Judge, the case of the petitioner- complainant was that his representation dated 25.04.2022 was required to be considered for the purpose of constituting a committee for management of the temple concerned notified under Section 25(3) of the Hindu Religious Institutions and Charitable Endowments Act, 1997. It was the case of the petitioner that there was a need for formation of such committee.
3. The writ petition came to be disposed of by learned Single Judge as per the order dated 04.07.2023, whereby the

respondents were directed to look into the grievance of the petitioner time-bound and consider the representation.

When contempt of the aforesaid directions was alleged by the complainant by filing this contempt petition, in response thereto, the compliance affidavit was filed by the Assistant Commissioner of Muzarai Works, Bengaluru in which, it was inter alia stated that respondent No.2-authority has considered the representation of the complainant and the endorsement dated 23.09.2024 was issued providing that necessary action has been taken to notify the temple under Section 23 of the Act pursuant to the complaints made by public. It was further stated that once the temple is notified under the said provision, the Managing Committee shall be constituted as per Section 25 of the Act.
5. In the above view, the authorities have substantially acted towards and in compliance with the directions of learned Single Judge. The Managing Committee could be formed only after notification of the temple under the Act. Therefore, it could not be said that any of the respondents have committed contempt of Court, much less a willful contempt.

6. The present contempt proceedings does not survive any further.
7. The contempt petition is accordingly disposed of as not surviving.
