(Oral) By way of instant petition, petitioner has prayed for the following main reliefs:- “a. That this Hon’ble Court may be pleased to issue writ of mandamus directing the respondent HIMUDA to immediately hold DPC for promotion to the post of Junior Engineer against the quota meant for Work Inspector/Draughtsman lying vacant from 01.08.2025 and further direct that the petitioner being senior most Work Inspector/Draughtsman may be promoted to the post of Junior Engineer. b. That this Hon’ble Court may be pleased to issue writ of mandamus directing the respondent HIMUDA to immediately decide the representation made by the petitioner for promotion to the post of Junior Engineer by convening DPC since the post if lying vacant and in view of the fact that the petitioner is to superannuate on 31.10.2025.” 2 2. Though in terms of order dated 14.10.2025, respondents were called upon to file reply, but learned vice counsel for the respondent has placed on record communication dated 15.10.2025, issued under the signatures of CEO-cum-Secretary HIMUDA, Shimla, to state that respondent-department, after having considered the representation of the petitioner, namely Mr. Surinder Shandil (Work Inspector), has found him eligible for promotion to the post of Junior Engineer (Civil), as such, his name has also been included in the list of persons, who are within the zone of consideration for promotion to the post of Junior Engineer (Civil). 3. Since Vigilance Clearance Certificate and other documents of Work Inspectors, who are in zone of consideration, are required. It has been undertaken through aforesaid letter, which is taken on record that matter shall be placed before Departmental Promotion Committee for consideration and recommendation for promotion of Work Inspector to the post of Junior Engineer (Civil) within ten days. 4. In view of the above, nothing remains to be adjudicated in the instant petition and accordingly, the same is disposed of with a direction to the respondents to ensure that DPC for promotion of the petitioner from Work Inspector to the post of Junior Engineer (Civil) is convened within ten days and thereafter, order of promotion pursuant 3 to recommendation, if any of the petitioner to the post of Junior Engineer (Civil) may also be issued.
