1. The present petition has been filed against willful violation of the impugned
order dated 05-08-2024 passed by the coordinate Bench of this Court in WPS No.1658/2022 whereby the respondent authorities were directed to take a decision on the departmental enquiry pending against the writ petitioner within a further period of 120 days from the date of receipt of copy of the order dated 05-08-2024.

Learned counsel for the petitioner would submit that the present contempt petitioner is complainant in the case and intervener in the writ petition. He has made his representation on 30-03-2025 intimating the competent Digitally signed by MOHAMMAD AADIL KHAN
2 authority about passing of the order dated 05-08-2024. Prior to that also they have orally informed the authority about passing of the order and to conclude the departmental enquiry proceeding which was pending against the writ petitioners, but till date the proceeding of departmental enquiry has not been completed, which is willful violation of the order dated 05-08-2024 passed by this Court.
3. I have heard learned counsel for the petitioner and perused the documents annexed with the petition.

From perusal of the order dated 05-08-2024 it reflects that the direction to the authority is to take decision on departmental enquiry pending against the writ petitioner within a further period of 120 days from the date of receipt of copy of the order dated 05-08-2024. However, the present petitioner has filed his representation along with copy of order dated 05-08-2024 on 30-03-2025 and thereby the stipulated period of 120 days is not completed. Further, it transpires that the present contempt petitioner was not a party to the writ petition and therefore, he cannot claim any willful violation of the order dated 05-08-2024 which has been passed on the writ petition filed by the writ petitioner. Accordingly, the present contempt petition is hereby dismissed. Sd/-
